IMPORTANT: PLEASE READ CAREFULLY

Fixabee is a MARKETPLACE PLATFORM that connects independent service providers with customers. We do NOT provide cleaning or any other services ourselves. Providers are NOT employees or agents of Fixabee. The contract for services is directly between you and the provider.

1. Introduction and Acceptance

Welcome to Fixabee ("Platform", "we", "us", "our"), operated by Aadhi Pixels Ltd. These Terms and Conditions ("Terms") govern your access to and use of the Fixabee mobile application and website (collectively, the "Services").

By creating an account, accessing, or using our Services, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our Services.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

2. Nature of the Platform

Fixabee is a technology marketplace platform. We facilitate connections between independent service providers ("Providers") and customers ("Customers"). We are NOT a cleaning company, service provider, or employer.

Fixabee expressly IS NOT:

  • A cleaning company or service provider of any kind
  • An employer, principal, or agent of any Provider
  • A party to the contract between Customers and Providers
  • Responsible for the quality, safety, or legality of services provided
  • Responsible for the qualifications, background, or conduct of Providers
  • An insurer or guarantor of any services or transactions

Providers are independent contractors who use the Platform to offer their services. They set their own rates, hours, methods, and terms of service. The contractual relationship for any services booked is solely between the Customer and the Provider.

3. Eligibility and Account Registration

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes

For Providers: You must additionally have the legal right to work in your jurisdiction, provide accurate date of birth for compliance verification, and maintain any required licences, permits, or insurance for the services you offer.

You are responsible for all activities that occur under your account. If you suspect unauthorised access, contact us immediately at support@fixabee.com.

4. Payments, Fees, and Escrow

All payments are processed securely by Stripe. Fixabee NEVER sees, stores, or has access to your full card details or bank account information. We only receive tokenised payment references.

4.1 Payment Processing

When a Customer books a service, payment is collected through Stripe and held in escrow until the service is completed and confirmed. This protects both parties by ensuring:

  • Customers only pay for completed services
  • Providers are guaranteed payment for services rendered

4.2 Platform Fee

Fixabee charges a platform fee (commission) on each transaction. This fee is deducted from the Provider's payment before transfer. The current fee rate is displayed during booking and in Provider account settings.

4.3 Escrow and Release

Funds are held in escrow and released to the Provider when:

  • The Customer confirms the booking is complete, OR
  • 24 hours pass after the Provider marks the service as complete without Customer dispute

4.4 Provider Payouts

Providers receive payments directly to their bank account via Stripe Connect. Providers must complete Stripe's identity verification and onboarding process to receive payouts. Payout timing depends on Stripe's processing schedule and the Provider's country.

5. Cancellations and Refunds

5.1 Customer Cancellations

Customers may cancel bookings subject to the following:

  • Free cancellation: Up to 24 hours before the scheduled service
  • Late cancellation: Within 24 hours may incur a cancellation fee
  • No-show: Failure to provide access or be present may result in full charge

5.2 Provider Cancellations

Providers who cancel bookings may face penalties including reduced visibility on the platform and, for repeated cancellations, account suspension.

5.3 Refunds

Refunds are processed through Stripe and typically appear within 5-10 business days depending on your bank. Fixabee does not control refund timing once processed.

6. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY

As a marketplace platform, Fixabee's liability is strictly limited. We connect Customers and Providers but do not perform, supervise, or guarantee any services.

6.1 No Liability for Services

Fixabee accepts NO LIABILITY for:

  • The quality, safety, legality, or suitability of any services provided by Providers
  • Any damage to property, including but not limited to breakage, staining, scratching, or destruction of items, furniture, fixtures, or premises
  • Theft, loss, or misappropriation of property or valuables
  • Personal injury or harm of any kind
  • Any consequential, incidental, indirect, or special damages
  • Lost profits, business interruption, or loss of data
  • Actions, omissions, or conduct of any Provider or Customer
  • Disputes between Customers and Providers

6.2 No Insurance Coverage

Fixabee does NOT provide insurance coverage for any services, property damage, or losses. Customers are strongly advised to:

  • Verify that Providers carry appropriate public liability insurance
  • Secure valuable items before any service
  • Maintain adequate home insurance coverage

6.3 Maximum Liability

To the maximum extent permitted by law, Fixabee's total aggregate liability to you for any claims arising from or related to the Services shall not exceed the greater of: (a) the platform fees you have paid to Fixabee in the 12 months preceding the claim, or (b) £100.

6.4 Platform Availability

We do not guarantee uninterrupted access to the Platform. We are not liable for any unavailability, delays, or technical issues.

7. Indemnification

You agree to indemnify, defend, and hold harmless Fixabee, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any services you provide or receive through the Platform
  • Any content you submit to the Platform

8. Disputes Between Users

Fixabee provides a dispute resolution process as a courtesy but is NOT obligated to resolve disputes between Customers and Providers. We may, at our sole discretion:

  • Facilitate communication between parties
  • Review evidence submitted by both parties
  • Make non-binding recommendations
  • Process refunds where clearly warranted

Our decisions are final and made at our sole discretion. For disputes involving significant damages or legal matters, you should seek independent legal advice and pursue resolution directly with the other party or through the courts.

9. Provider-Specific Terms

If you use Fixabee as a Provider, you additionally agree that:

  • You are an independent contractor, NOT an employee of Fixabee
  • You are solely responsible for paying all applicable taxes on your earnings
  • You will maintain any required licences, permits, and insurance
  • You will provide services professionally and in accordance with applicable laws
  • You will accurately represent your qualifications and experience
  • You are responsible for your own equipment, supplies, and transportation
  • You will complete Stripe onboarding to receive payments

Fixabee does not control how, when, or where you provide services. You retain full autonomy over your work methods, schedule, and the customers you choose to serve.

10. Customer-Specific Terms

If you use Fixabee as a Customer, you additionally agree that:

  • You will provide accurate booking information and access instructions
  • You will be present or ensure access at the scheduled time
  • You will treat Providers with respect and dignity
  • You will secure valuables and fragile items before service
  • You will provide a safe working environment
  • You understand that the Provider, not Fixabee, is responsible for the service
  • You will confirm or dispute completed bookings in a timely manner

11. Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or discriminate against any user
  • Provide false or misleading information
  • Circumvent the Platform to avoid fees
  • Interfere with the proper functioning of the Platform
  • Use the Platform for any unlawful purpose
  • Collect user information without consent
  • Create multiple accounts to evade restrictions

11a. User-Generated Content & Community Standards

Fixabee has zero tolerance for objectionable content or abusive users.

All user-generated content posted to Fixabee, including posts, comments, messages, and profile information, is subject to our community standards. By using the Platform, you agree to the following:

  • Content Filtering: Fixabee employs automated content filtering to prevent objectionable material from being posted. Content that is flagged may be held for review before being published.
  • Content Reporting: Users may report any content or user that violates our community standards. All reports are reviewed by our moderation team.
  • User Blocking: You may block any user at any time. When you block a user, their content is immediately removed from your feed, they cannot view your posts or profile, and they cannot send you messages. All blocks are reported to our moderation team for review.
  • Moderation Response: Our moderation team reviews and acts on all reports of objectionable content within 24 hours. Offending content will be removed and the user responsible may be warned, suspended, or permanently banned.
  • Prohibited Content: Content that is harassing, threatening, abusive, discriminatory, sexually explicit, violent, fraudulent, or otherwise objectionable is strictly prohibited and will be removed.

Users who repeatedly violate our community standards will have their accounts permanently terminated. Fixabee reserves the right to remove any content and suspend any user at its sole discretion.

12. Account Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Repeated cancellations or poor conduct
  • Non-payment or payment disputes
  • Any reason at our sole discretion

You may delete your account at any time through the app settings. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Intellectual Property

The Fixabee name, logo, and all related trademarks, service marks, and content are the property of Aadhi Pixels Ltd. You may not use our intellectual property without express written permission. Content you submit to the Platform remains yours, but you grant us a licence to use it for operating the Services.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
